Welcome to 4Shor. By using our app, you agree to these terms. Please read them carefully.
1. About 4Shor
4Shor is a surf and water sports forecasting application that provides wave, wind, and weather information for beaches across Europe. The service is operated by Alcis Ltd, a company registered in England and Wales.
2. Acceptance of Terms
By downloading, installing, or using 4Shor, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the app.
3. Important Safety Information
FORECASTS ARE ESTIMATES ONLY: Ocean and weather conditions are inherently unpredictable. Our forecasts are based on computer models and may not accurately reflect actual conditions. CONDITIONS CAN CHANGE RAPIDLY: Wave heights, currents, and weather can change quickly and without warning. ASSESS CONDITIONS YOURSELF: Always check actual conditions at the beach before entering the water. USE YOUR JUDGMENT: Never rely solely on any forecast app for safety decisions. YOUR SAFETY IS YOUR RESPONSIBILITY: 4Shor is an informational tool only. We are not responsible for any decisions you make based on our forecasts.
4. User Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information and keep it updated. We reserve the right to suspend or terminate accounts that violate these terms.
5. Free Preview Period
4Shor is currently in a free preview period. During this time, all features are available at no cost. We plan to introduce paid subscription tiers at full launch. We will notify users in advance of any changes to pricing or feature availability. Continued use after the introduction of paid subscriptions will be subject to the terms in effect at that time.
6. Acceptable Use
You agree not to: use the service for any unlawful purpose; attempt to reverse engineer, decompile, or extract source code; use automated systems to access the service without permission; interfere with or disrupt the service; share your account credentials; or resell or redistribute forecast data without permission.
7. Intellectual Property
4Shor, including its logo, design, and content, is owned by Alcis Ltd and protected by copyright and trademark laws. Forecast data is derived from publicly available sources including Copernicus Marine Service (CMEMS), ECMWF, and EMODnet. You may use the app for personal, non-commercial purposes only.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT FORECASTS WILL BE ACCURATE, COMPLETE, OR TIMELY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALCIS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS. THIS LIMITATION APPLIES REGARDLESS OF WHETHER DAMAGES ARISE FROM INACCURATE FORECASTS, SERVICE INTERRUPTIONS, OR ANY OTHER CAUSE.
10. Indemnification
You agree to indemnify and hold harmless Alcis Ltd from any claims, damages, or expenses arising from your use of the service or violation of these terms.
11. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via the app or email. Continued use after changes constitutes acceptance of the new terms.
12. Termination
We may suspend or terminate your access to the service at any time for violation of these terms or for any other reason at our discretion. You may stop using the service at any time.
13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in the EU, you may also have rights under your local consumer protection laws.
